The following detailed instructions for amendment of the Documents are forwarded for your information and necessary action please: TENDER DOCUMENT General queries Q1: Labour Rates to be paid – Please confirm that this is not an EPWP project and that the tenderers must therefore base the pricing on BCCEI rates. A1: Please note that Tender 84Q/2025/26 is an EPWP project. The Tenderer is however still required to comply with the applicable BCCEI labour rates when pricing. For clarification, EPWP applies to targeted labour paid below the maximum threshold rate. The current maximum rate for classification as an EPWP worker is R500.00 per day. Accordingly, all Targeted labour remunerated in line with BCCEI rates that fall below the R500.00/day threshold must be recorded as targeted labour under EPWP. Any worker paid above the R500.00/day threshold cannot be claimed as an EPWP worker. Targeted EPWP labour: Tenderers must apply the applicable BCCEI rates when pricing EPWP workers. Should a tenderer wish to pay below the BCCEI rates, this may only be done if an exemption has been obtained from the BCCEI. All other labour: The applicable BCCEI rates must be used. With respect to the conditions of employment: Tenderers are required to comply with the BCCEI collective conditions of employment. The EPWP framework does not override these obligations. The R500.00/day threshold is applied for classification purposes only, i.e. to determine whether a worker may be recorded as EPWP labour. This threshold value is set by the Department of Public Works and Infrastructure and is subject to adjustment from time to time, including during the contract period. The threshold excludes additional benefits such as allowances, bonuses, and leave entitlements. These benefits must still be provided in accordance with the BCCEI collective agreement unless an exemption has been granted by the BCCEI. Q2: CPG Targets – Can more wards be added [to] assist in the achievement of the CPG targets? It will be very challenging to achieve a 10% spend in only 2 wards. A2: The Targeted Enterprises contract participation goal (CPGE) of 10% may be achieved through suppliers, service providers or works, for which the Contractor contracts targeted enterprises, either directly or indirectly, in the performance of the contract, as follows: a) by engaging one or more targeted enterprises to perform commercially useful functions in the performance of the contract; b) by engaging non-targeted enterprises, who in turn engage one or more targeted enterprises to perform commercially useful functions in the performance of the contract; c) by a combination of the above. The Contractor will be required to submit, to the Employer’s Agent, a detailed CPG Implementation Plan demonstrating how the minimum CPGE requirements will be achieved using Targeted Enterprises within the prescribed Target Area. The Employer’s Agent will only consider any request to expand the Target Area into adjacent Wards or Sub-councils once the Contractor has provided substantive evidence that all reasonable options, engagements, and available resources within the designated area have been fully exhausted. Such a request cannot be based on assumptions or perceived difficulty; it must be clearly justified and supported by proof. Furthermore, expanding the Target Area is not encouraged, as it may expose the Contractor to allegations of exclusion or undue pressure from enterprises within the original Target Area who may claim they were bypassed in favour of service providers from outside the Target Area. Q3: Sidewalk roadbed prep – Please add the relevant payment item under C5.1.1 for sidewalk roadbed prep. A3: Payment item C5.1.1.2 Compaction of in-situ material to 93% of MDD (50mm under sidewalks), was added to the BoQ. Q4: Processing sidewalk selected layers (G7) – Please add the relevant payment item under C5.3.2 for the construction of sidewalk selected layers. Only material is paid under C4.4.
