Objectives

The primary objective of this tender is to appoint a qualified service provider to deliver external legal services for the registration of land and rights acquired during the implementation of AMD Projects in the Eastern and Central regions. The appointed provider will facilitate the registration process for land parcels and servitudes, ensuring proper legal transfer and rights registration in accordance with relevant laws and regulations.

Scope

The scope of work includes:

• Registration of land parcels (specifically 2 land parcels) and 15 servitudes acquired by TCTA in the context of the AMD project.
• Execution of all related tasks inherent to land registration and rights transfer.
• Determination of the value of registrable rights as required for the registration process.
• Provision of deeds of registration into the name of TCTA.

Technical Requirements

The technical requirements for the service provider include:

• Proof of registration/membership with the Legal Practice Council (LPC), with a practice period of at least 5 years.
• Personnel must include a conveyancing practitioner with a minimum of 5 years post-registration experience, evidenced by a valid LPC registration certificate.
• Admitted legal practitioners must be in good standing, supported by a valid letter of good standing from the LPC.
• Designated resource must provide evidence of registration of articles.
• Provision of deeds of registration for the relevant land and rights into TCTA’s name.
• Proof of business addresses within Gauteng, such as lease agreements or municipal accounts.
• Submission of valid BBBEE certificates or sworn affidavits as per requirements.

Skills Requirements

The skills and experience required from the service provider and personnel include:

• Company Experience:
  • Minimum 5 years of registration/membership with the LPC.
  • Demonstrated experience in land registration, with at least 11 years of practice for maximum points.
  • At least 3 reference letters from previous land registration projects.
• Personnel Experience:
  • Conveyancing Practitioner with at least 5 years post-registration experience.
  • Proof of registration as an admitted conveyancer.
  • Candidate Attorney with registration of articles, with experience ranging from 0 to 24 months.
• Additional Skills:
  • Ability to determine the value of rights for registration purposes.
  • Legal expertise in land transfer procedures and rights registration.
