Objectives

The primary objective of this tender is to establish a Panel of Attorneys for the Ray Nkonyeni Municipality to provide a wide range of legal services over a period of three years. The services aim to support the municipality in both litigious and non-litigious legal matters, including litigation, contract drafting, conveyancing, legal opinions, forensic reports, and other legal support as required.

Scope

The scope of work includes, but is not limited to:

• Representation in litigation before courts such as Magistrate, High, and Superior Courts, including constitutional and labour courts, arbitration, and bid appeal tribunals.
• Drafting, vetting, and reviewing various legal contracts such as lease agreements, joint ventures, and property transactions.
• Providing legal opinions on a broad spectrum of legal issues.
• Supporting municipal departments in settling disputes and legal processes related to municipal by-laws, demolition orders, interdicts, and related matters.
• Assisting with conveyancing, property transfers, cancellations, and application for lost title deeds.
• Legal support in Labour Law, Town Planning, Environmental Law, Debt Collection, and Forensic Services.
• Appointing external professionals (e.g., town planners, architects) for specialized legal support.

Legal service providers will receive instructions on an ad-hoc basis as needs arise, with no guaranteed quantum of work.

Technical Requirements

Applicants must demonstrate:

• Company experience with at least 50 signed appointment/instruction letters relating to legal services in a government environment, not older than six years.
• Experience of the most senior professional attorneys, including certified qualifications, admission certificates, and CVs, with foreign qualifications verified by SAQA.
• Capacity and capability evidenced by company profile, organogram, and CVs of staff, showing ability to handle legal disbursements (minimum R20,000 per matter).
• Legal practitioners must be members of the relevant Legal Practise Council and in good standing.
• Provision of affidavits from partners/directors confirming the ability to carry disbursements and other legal support capacity.

Additional technical criteria include experience in specific legal categories such as Litigation, Supply Chain Management, Commercial Law, Conveyancing, Labour Law, Town Planning, Environmental Law, Debt Collection, and Forensic Services.

• Legal expertise across multiple categories of law relevant to municipal needs.
• Proven experience in government legal services and litigation.
• Ability to draft, review, and vet legal contracts and documents accurately and efficiently.
• Capacity to provide legal opinions and forensic reports that are court-testable and authenticated.
• Strong organizational skills, including CVs, company profiles, and supporting documentation demonstrating capacity.
• Members of the legal team must be qualified attorneys, with foreign qualifications verified where applicable, and in good standing with the Legal Practise Council.
• Ability to respond promptly to legal instructions and support the municipality in legal dispute resolution and advisory services.
