Technical Requirements

Bidders must supply products that strictly conform to the following specifications and quality benchmarks:

• Quality Certification: Must meet ISO quality standards.
• Vacuum Gauge: Must feature colour-coded indicators that provide immediate visual feedback on the vacuum pressure inside the cup.
• Traction Force Indicator: Mandatory safety feature displaying the exact traction force applied during operation.
• Material & Design: Disposable units eliminating the need for sterilisation. Must combine a soft sponge interface to cushion the infant’s head with a rigid cup structure to ensure optimal mechanical grip.
• Product Condition: New, unused, and representing the most recent or current market model. All delivered stock must retain a minimum validity period of six months.
• Physical Sampling: Actual physical samples must be submitted when available for direct verification against the stated specifications.

Skills & Qualification Requirements

This procurement does not mandate specific technical trade skills. Instead, compliance is assessed through regulatory, administrative, and commercial qualifications:

• Regulatory Authorisation: A valid licence from the South African Health Products Regulatory Authority (SAHPRA) permitting the bidder to manufacture, import, export, or wholesale/distribute medical devices.
• Entity Verification: Active Central Suppliers Database (CSD) registration with verified tax compliance status, alongside updated CIPC business registration documents.
• Administrative Compliance: Submission of completed statutory returnable forms, including the Bidder’s Disclosure (SBD 4) for conflict-of-interest declarations and the Preference Points Claim Form (SBD 6.1).

Key Contractual Terms & Unusual Provisions

The tender incorporates standard public sector procurement frameworks alongside specific operational directives:

• 80/20 Preference System: Evaluation awards 80 points for competitive pricing and 20 points for specific socio-economic goals. Full points for the specific goal are exclusively granted to enterprises that are majority South African-owned.
• Anti-Cover-Quoting Clause: Bidders are strictly prohibited from submitting multiple quotations to artificially influence pricing or evaluation rankings. This practice is classified as procurement fraud and may result in immediate disqualification and potential public sector exclusion.
• Performance Security: The awarded supplier must provide a bank guarantee or certified cheque as performance security within thirty days of contract notification.
• Warranty Coverage: Suppliers warrant that goods are free from design, material, or workmanship defects for twelve months post-delivery or eighteen months post-shipment, whichever occurs first.
• Delay Penalties: Failure to deliver within the agreed timeframe triggers daily financial penalties calculated using the current prime interest rate applied to the value of the delayed goods.
