Objectives

The primary objectives of this tender are to:

• Establish a panel of specialized private attorney firms to provide legal services to the Department of Public Works & Infrastructure (DPWI) on an ad-hoc basis for a period of three years.
• Ensure skills transfer to the Department’s internal Legal Services component.
• Expedite the process for selecting legal service providers when urgent legal assistance is required.
• Enhance efficiency by utilizing a rotational panel of legal service providers for various legal matters.

Scope

The scope of work includes providing specialized legal services in the following areas:

• Representation of the Department and the Honourable MEC in legal matters as required.
• Provision of legal advisory services on an ad hoc basis.
• Legislative drafting for the Department.

The legal services will be utilized on a rotational basis, and firms may be called upon for representation, advice, or legislative drafting as needed.

Technical Requirements

The technical requirements for the tender include:

• Submission of a comprehensive company profile indicating at least five years of experience and at least one partner with ten years post-admission experience.
• Provision of proof of expertise in specified legal areas, including construction, procurement, commercial, land, conveyancing, and labor law.
• Submission of CVs formatted as per Annexure C (practicing attorneys) and Annexure D (support staff).
• Evidence of previous legal work, communication records, invoices, or similar proof for each area of specialty.
• Demonstration of capacity to transfer skills and ensure transformation within the legal sector.

Skills Requirements

The skills and qualifications required from participating firms include:

• Qualified attorneys with practicing certificates in relevant legal fields.
• Experience in handling legal matters related to construction, procurement, commercial law, land disputes, conveyancing, and labor law.
• Ability to provide legal advisory services, representation, and legislative drafting.
• Demonstrated capacity for effective communication, record-keeping, and attendance at legal matters (as per Annexure E).
• Preference will be given to firms with female partners, partners from previously disadvantaged groups, and disabled partners.
• Compliance with the Department’s policies on transformation and skills transfer.
