Objectives

The primary objective of this tender is to appoint a panel of qualified Public Claims Adjusters to provide comprehensive claims management services for the eThekwini Municipality over a period of 36 months. The services include assessing, formulating, substantiating, and quantifying complex, large, or catastrophic insurance claims, representing the municipality in legal proceedings, and providing related advisory and support functions to ensure effective claims handling and risk management.

Scope

The scope of work encompasses:

• Provision of Public Claims Adjuster services for assets including Assets All Risks, Business Interruption, Liabilities, and other related claims.
• Handling complex/large/catastrophic claims estimated from R15 million and above.
• Acting on behalf of the municipality in assessing damages, identifying deficiencies, proposing solutions, and categorizing claims by department and site.
• Conducting site inspections, data collection, cause of loss assessment, and quantification of claims.
• Preparing detailed reports, claim documentation, and supporting evidence, including sworn affidavits, photographs, and expert opinions.
• Attending legal proceedings, providing sworn affidavits, and participating in negotiations or dispute resolutions.
• Ensuring compliance with insurance policies, standards, and best practices, and advising on remedial/preventative measures.

Technical Requirements

The technical requirements include:

• Demonstrated experience with at least one claim within the last five years involving a payout of R20 million or more, with relevant supporting documentation.
• Minimum of three qualified Public Claims Adjusters with expertise in electrical, mechanical, civil engineering, and quantity surveying, all with at least five years post-registration experience.
• Provision of professional indemnity insurance of at least R15 million, with proof of coverage.
• Ability to assess, document, and substantiate claims accurately, including cause analysis, damage categorization, and cost estimation.
• Capacity to perform site inspections, data analysis, and prepare comprehensive reports within specified timeframes.
• Availability of local office presence within the eThekwini Municipality boundary for effective service delivery.

Skills Requirements

The successful bidder must possess:

• Extensive experience in public claims adjusting, particularly for large and complex claims.
• Strong technical expertise in engineering disciplines (Electrical, Mechanical, Civil/Quantity Surveying) and insurance claims management.
• Proven ability to handle legal and litigation support, including court appearances and sworn affidavits.
• Excellent report writing, analytical, and communication skills.
• Capacity to work independently, with high integrity, objectivity, and adherence to best practices and standards.
• Demonstrated compliance with professional indemnity requirements and relevant regulatory standards.
