Objectives

The primary objective of this tender is to appoint a Transport Law Specialist who will provide services for drafting regulations to support the implementation of the Eastern Cape Master Plan for Transport Service Centres. The specialist will assess the legal feasibility of the Department of Transport taking responsibility for licensing functions, audit the current legal environment, design a legally defensible operating model, and support the implementation of transport regulations and notices.

Scope

The scope of work includes:

• Providing guidance on legal feasibility regarding licensing responsibilities in the Eastern Cape.
• Auditing the current legal environment related to transport regulations.
• Designing a legally defensible operating model for Transport Service Centres in the Eastern Cape, including legal and institutional implications.
• Supporting the drafting of regulations, notices, and supporting documents for the implementation of the Eastern Cape Transport Master Plan.
• Ensuring all instruments related to Transport Centres’ operations and legal compliance are developed.

Technical Requirements

The technical requirements for the successful bidder include:

• Demonstrated experience in drafting legislation, regulations, or statutory instruments, including supporting their implementation (minimum 10 years preferred).
• Experience working with the National Road Traffic Act and related transport and road traffic regulatory frameworks (more than 10 years preferred).
• Post-admission legal experience, particularly in road traffic and transport regulatory environments (more than 10 years preferred).
• Provision of contactable references for relevant transport law projects.
• Qualifications including a Bachelor of Laws (LLB), postgraduate law qualification, and registration with the Legal Practice Council (LPC) of South Africa.
• Optional: Valid Fidelity Fund Certificate (FFC) for individual directors/partners.
