Objectives

The primary objective of this tender is to establish a panel of experienced legal practitioners who can provide specialised legal services to the Rustenburg Local Municipality over a period of three years. The aim is to support the municipality in various legal areas, ensure legal compliance, and facilitate effective legal management through a service level agreement.

Scope

The scope of the tender includes:

• Establishing a panel of qualified attorneys to assist with legal services as required.
• Providing legal expertise across a broad spectrum of law fields, including but not limited to:
• Administrative Law
• Commercial Law
• Company Law
• Constitutional Law
• Eviction Law (PIE, ESTA)
• Energy Law
• Environmental Law
• Housing and Land Tenure Laws
• ICT Law
• Labour and Employment Law (advisory, litigation, arbitrations)
• Civil Litigation (various courts and arbitrations)
• Local Government Law
• Municipal Finance Management Act
• Property Law (including conveyancing and Spluma)
• Security and Policing Law
• Transportation Law (including relevant Acts)
• Tax Law and Trusts Law
• Construction Law
• Public Procurement Law

The services will be rendered as and when required, with the appointment being subject to a service level agreement. The municipality also reserves the right to appoint senior counsel for complex matters and to avoid conflicts of interest by not accepting instructions from third parties against the municipality.

Technical Requirements

The technical requirements include:

• Completion of all bid documentation according to specified guidelines.
• Provision of detailed CVs, proof of qualifications, and relevant experience for key personnel, including lead attorneys and associates.
• Demonstration of experience in legal services related to local government and similar projects, supported by reference letters and appointment letters.
• Availability to provide legal services on a rotational basis, with timely case finalisation and case management.
• Adherence to prescribed fee structures, invoicing procedures, and supporting documentation.
• Compliance with verification processes for tax status, CIDB grading (if applicable), and other legal requirements.
• Provision of advanced technological facilities to facilitate legal research, document management, and communication.

Skills Requirements

The skills and competencies required from bidders include:

• Extensive experience in the fields of law specified, particularly in local government legal matters.
• Proven track record of providing legal advisory and litigation services within the public sector.
• Qualified legal practitioners with valid admission certificates, Fidelity Fund Certificates, and good standing with the South African Legal Practice Council.
• Ability to handle multiple legal disciplines, including complex litigation, advisory, and transactional work.
• Strong case management and case finalisation skills to ensure timely resolution of legal matters.
• High ethical standards, professionalism, and confidentiality in handling municipal legal affairs.
• Technological proficiency to support efficient legal research, document management, and communication.
• Capacity to provide dedicated legal personnel, including lead attorneys and qualified associates or candidate attorneys.
