Objectives

The primary objective of this tender is to deliver specialized, high-level training to fourteen (14) departmental officials. The programme aims to strengthen their capacity to effectively manage, interpret, and administer complex construction contracts within the public infrastructure sector, ensuring compliance, risk mitigation, and efficient project execution.

Scope

The service encompasses a five-day intensive training programme delivered through contact (in-person) classes. The curriculum focuses on advanced construction contract principles, featuring in-depth legal analysis and practical application of four major contract suites: JBCC, GCC, NEC, and FIDIC. The training will utilise real-world case studies to foster experiential learning. Participation is strictly capped at fourteen officials.

Technical Requirements

• Mandatory accreditation and validation by the South African Council for the Project and Construction Management Professions (SACPCMP).
• Submission of a comprehensive, itemised course content outline.
• Attachment of valid SACPCMP accreditation/validation certificates.
• Completion of all prescribed Standard Bid Document (SBD) forms, including proof of Central Supplier Database (CSD) registration, Tax Compliance Status (TCS), and Broad-Based Black Economic Empowerment (B-BBEE) verification documentation (SANAS-accredited certificate or sworn affidavit).
• Submission of a fully priced quotation covering all direct and indirect costs, inclusive of VAT.
• Adherence to the General Conditions of Contract (GCC) and the preferential procurement scoring framework.
• Readiness to submit security clearance documentation if requested post-award.

Skills Requirements

• Demonstrated expertise in construction law, contract administration, and dispute resolution.
• In-depth knowledge of the JBCC, GCC, NEC, and FIDIC contract frameworks, including clause interpretation, risk allocation, and variation management.
• Proven track record of designing and delivering accredited professional development training for government or construction industry professionals.
• Ability to develop and facilitate practical, scenario-based case studies relevant to South African public works projects.
• Strong instructional and facilitation skills tailored for adult learners in a classroom environment.

• SACPCMP Accreditation: A statutory professional body in South Africa responsible for regulating and validating training providers and programmes in project and construction management. Only courses formally endorsed by this council qualify for this tender.
• Contract Suites (JBCC, GCC, NEC, FIDIC): Standardised sets of contractual terms used globally and locally in construction. JBCC and GCC are South African frameworks, while NEC and FIDIC are international standards. Each dictates specific rights, obligations, payment mechanisms, and dispute procedures, requiring specialised legal and commercial expertise to teach effectively.
• 80/20 Preference Point System: A South African public procurement evaluation model where 80 points are awarded for competitive pricing and 20 points for socio-economic transformation goals (e.g., ownership by black people, women, youth, or persons with disabilities).
• CSD & TCS: The Central Supplier Database is the national registry for all government contractors. Tax Compliance Status is a SARS-issued identifier confirming a bidder meets all tax obligations. Both are mandatory administrative prerequisites for all South African state tenders.
