Objectives

The primary objective of this tender is to appoint legal practitioners to provide legal, advisory, and litigation services to the Limpopo Department of Education over a period of thirty-six (36) months. The appointed practitioners will serve on a panel and be engaged on an ad hoc basis as required by the Department, supporting various legal needs including litigation, legal opinions, drafting, and advisory services.

Scope

The scope of work includes, but is not limited to:

• Assisting with cases related to educational law, administrative law, constitutional law, construction law, arbitration, contract law, corporate law, general commercial law, and labour law.
• Providing legal advice, drafting and vetting contracts, policies, and legislation.
• Representing the Department in court proceedings across all levels (Magistrates’, Labour, High Court).
• Enforcing judgments, debt collection, and managing litigation processes.
• Providing opinions on legal matters, drafting Heads of Argument, and legal opinions.
• Advising on procurement, tenders, and related agreements.
• Applying legal expertise in constitutional and administrative law, including compliance with relevant legislation and regulations.

Technical Requirements

The technical requirements for bidders include:

• Legal practices must be established in accordance with the Attorney Act, 1979 and the Legal Practice Act, 28 of 2014.
• Bidder must score at least 70% on the technical evaluation, which considers:
• Legal practitioners with a minimum of 3 years post-admission experience, supported by admission certificates.
• Provision of appointment letters, instructions, and reference letters confirming relevant work experience.
• Management and litigation experience, including proof of judgments, heads of argument, or opinions in relevant legal fields.
• Proof of registration with the Legal Practice Council and a valid Fidelity Fund Certificate.
• Compliance with the Department’s locality verification via CSD reports and proof of address.
• All documentation must be complete, signed, and submitted as per the bid requirements.

Skills Requirements

Applicants must demonstrate:

• Extensive experience in legal practice, particularly in education, constitutional, administrative, and commercial law.
• Proven litigation management skills, including handling court cases, drafting pleadings, and legal opinions.
• Ability to advise on complex legal issues, draft legislation, policies, and contractual documents.
• Strong understanding of the legal framework governing public sector procurement, tenders, and compliance.
• Capacity to brief counsel, manage litigation, and enforce judgments effectively.
• Good record of professional conduct, verified through good standing certificates and adherence to the Legal Practice Council’s code of conduct.
