Objectives

The primary objective of this tender is to appoint a panel of qualified legal practitioners to provide comprehensive legal services to the Phokwane Local Municipality over a period of 36 months. The services aim to support the municipality in areas such as contracts management, litigation, legal compliance, council legal matters, municipal courts, governance of municipal entities, specialized commercial legal services, and by-law compilation. The appointment is contingent upon the signing of a service level agreement and aims to ensure efficient legal support to achieve the municipality's strategic goals while promoting local enterprise development and transformation.

Scope

This tender encompasses the appointment of a panel of legal service providers to deliver legal services on an "as and when required" basis for a duration of 36 months. The scope includes:

• Assistance with contracts management and drafting
• Handling litigations and claims in various courts
• Providing legal advice on corporate, constitutional, environmental, energy, land, property, and municipal law
• Representation in municipal courts and tribunals
• Legal compliance and governance of municipal entities
• Specialized commercial legal services
• By-law compilation and review
• Legal advisory services in areas such as labour, energy, environmental, and procurement law

The municipality reserves the right to appoint multiple legal practitioners or law firms, and to allocate work based on the nature and complexity of legal matters, ensuring efficient case management and conflict of interest avoidance.

Technical Requirements

The successful bidders must demonstrate:

• Experience in providing legal services to local government and related entities
• Capability to handle a broad spectrum of legal fields including administrative, commercial, constitutional, land, property, labour, and procurement law
• Availability to provide legal services promptly as required
• Compliance with the municipality’s service standards, including timely case finalization and reporting
• Provision of detailed CVs, proof of registration with the Legal Practice Council, Fidelity Fund Certificate, and Good Standing Certificate
• Adherence to the agreed fee structure, with detailed invoicing and supporting documentation
• Use of advanced technology and facilities to facilitate legal research, document management, and communication
• Implementation of confidentiality, ethical standards, and conflict of interest policies
• Return of all files and documentation upon contract termination

Skills Requirements

The tender requires service providers to possess:

• Legal expertise across multiple law disciplines relevant to municipal operations
• Proven experience in municipal legal matters, litigation, and legal advisory roles
• Qualified attorneys with a minimum of 3 years post-admission experience in relevant fields
• Support staff such as professional assistants and candidate attorneys with appropriate qualifications and experience
• Strong communication, negotiation, and settlement skills to resolve disputes efficiently
• Technological proficiency to support research, document management, and remote communication
• High ethical standards, professionalism, and confidentiality in handling municipal legal matters
• Capacity for continuous engagement, reporting, and skills transfer to municipal officials
