Objectives

The primary objective of this tender is to appoint a panel of attorneys to provide legal support and services to the Dr Kenneth Kaunda District Municipality over a period of three (3) years, as and when required. The successful bidders will form part of a panel to deliver legal assistance, including court proceedings, legal advice, drafting, and other related legal services.

Scope

The scope of work includes, but is not limited to:

• Providing legal support during court proceedings and legal consultations.
• Institution of legal proceedings at appropriate tribunals, forums, or courts.
• Drafting legal documents, notices, pleadings, and correspondence.
• Perusing documents and providing legal opinions.
• Offering legal advice on matters related to local government, labour law, civil litigation, drafting of bylaws and policies.
• Representing the municipality in legal matters, including litigation and legal negotiations.
• Appointing counsel and other legal experts on complex matters, on a rotational basis, through the municipality’s SCM process.

Technical Requirements

The technical requirements for bidders include:

• Registration on the South African Revenue Service (SARS) for tax compliance, with valid tax clearance certificates or SARS PINs.
• Proof of company registration (e.g., company registration certificate, close corporation number).
• Certified copies of identity documents of partners or directors.
• Demonstrated experience in local government legal matters, civil litigation, and forensic investigation, supported by instruction and reference letters (minimum of 12, with at least 3 in forensic investigation).
• Provision of a portfolio of evidence demonstrating functionality, including main office location, directors’ experience (minimum 2-10 years), and capacity of staff and support personnel.
• Adherence to the specified service levels, including signing a Service Level Agreement within 30 days of appointment.
• Compliance with the legal practice act and adherence to the Law Society of South Africa’s fee guidelines.

Skills Requirements

The skills and expertise required from bidders include:

• Extensive knowledge of local government legislation, labour law, civil litigation, and drafting of bylaws and policies.
• Experience in forensic investigations and legal proceedings related to local government.
• Qualified legal practitioners with a minimum of 2-10 years’ experience in relevant legal fields.
• Capability to provide legal advice, draft legal documents, and represent the municipality in courts and tribunals.
• Capacity to manage multiple legal matters efficiently, including court appearances, legal negotiations, and legal opinions.
• Ability to operate within the municipality’s SCM policies, including rotational appointment of legal service providers and adherence to procurement regulations.
