Objectives

The primary objective of this tender is to appoint a panel of legal practitioners to provide legal services to the Mpumalanga Tourism and Parks Agency (MTPA) for a period of three years. The appointed panel aims to support the agency in various legal areas, ensuring effective legal advice, representation, and compliance with relevant laws and regulations to facilitate the agency's mandate of sustainable tourism development and conservation.

Scope

The scope of the tender encompasses the appointment of legal practitioners or law firms with expertise in a broad range of legal areas relevant to the operations of a public entity in South Africa. Specifically, the scope includes:

• Provision of legal services across multiple legal disciplines such as Administrative Law, Constitutional Law, Civil Law, Commercial Law, Competition Law, Contract Law, Environmental Law, Human Rights Law, Labour Law, Land Law, and other related fields.
• Legal advisory, representation, and support in litigation, compliance, and regulatory matters.
• Experience in areas such as Banking and Financial Law, Consumer Protection, Corporate Law, Criminal Law, Environmental Legislation, Governance, Risk and Compliance, Health and Safety, Intellectual Property, International Trade Laws, and other relevant legal fields.
• Provision of services related to procurement, property law, legal drafting, and other legal support functions necessary for the agency’s operations.
• Work will be allocated on a rotational basis, depending on urgency, skills required, and the nature of the legal matter.

Technical Requirements

The technical requirements for the tender include:

• Legal practitioners or firms must demonstrate relevant experience and expertise in the specified legal areas, supported by proven track records and references.
• Professionals must hold appropriate qualifications (e.g., LLB, LLM) and be admitted as attorneys or advocates registered with the Legal Practice Council or equivalent body.
• Applicants must provide detailed CVs of key professionals, including their experience in public sector legal matters and specific areas of law as per the scope.
• Firms must submit proof of registration, tax compliance status, and compliance with the Central Supplier Database (CSD).
• Applicants should indicate their capacity to provide the required legal services, including staffing levels, resources, and ability to meet the agency’s needs.
• All submissions must conform to the prescribed bid documentation and submission procedures, including timely delivery and adherence to bid specifications.
• Selected panel members will be subject to performance evaluations, confidentiality agreements, and compliance with the agency’s policies and legal standards.
