Objectives

The primary objective of this tender is to appoint a panel of legal service providers to deliver comprehensive legal services to the Namakwa District Municipality over a period of 36 months. The panel will provide legal expertise in areas such as municipal law, labour law, contract and commercial law, litigation, legislative support, policy development, revenue enhancement, and specialized legal services including eviction and insurance law.

Scope

The scope of work includes, but is not limited to:

• Legal advisory and representation in municipal, administrative, labour, contract, and commercial law matters.
• Litigation in various courts and tribunals including Magistrates’, High Court, Supreme Court of Appeal, and CCMA.
• Drafting, review, and vetting of contracts, policies, by-laws, and legislative support.
• Providing legal support for special assignments such as complex transactions, investigations, and policy development.
• Legal services related to revenue collection, eviction proceedings, insurance law, environmental legislation, and other specialized areas.
• Provision of legal opinions, policy drafting, and legal research.
• Services in specific categories such as eviction and insurance law, with proven experience and expertise required.

Technical Requirements

The legal service providers must:

• Meet eligibility criteria including registration on the Central Supplier Database, valid tax compliance PIN, Fidelity Fund Certificate, and Letter of Good Standing.
• Demonstrate experience in municipal law, litigation, and specialized legal areas relevant to municipal operations.
• Provide evidence of key personnel qualifications, experience, and organizational capacity.
• Adhere to the prescribed evaluation criteria, including quality, experience, personnel capacity, and response times.
• Submit all returnable documents, including financial statements, company profile, and supporting evidence of experience and references.
• Comply with the procurement and contractual standards outlined in the tender documentation, including the General Conditions of Contract and specific contractual clauses.

Skills Requirements

The successful bidders must demonstrate:

• Strong legal research and advisory skills, with the ability to provide comprehensive legal opinions.
• Proven litigation experience across various courts and tribunals.
• Expertise in municipal, administrative, labour, contract, and commercial law.
• Experience in handling complex legal transactions, policy development, and specialized legal services such as eviction and insurance law.
• Capacity to provide timely legal services with response times aligned to the specified SLA (e.g., within 24-48 hours for urgent matters).
• Ability to work collaboratively with municipal officials and adhere to reporting and reporting standards.
• Capability to provide legal support for policy drafting, legislative compliance, and revenue recovery initiatives.
