Objectives

The primary objective of this tender is to establish a panel of private practising attorneys to provide legal services to the Northern Cape Department of Economic Development and Tourism (DEDAT) over a period of thirty-six (36) months. The attorneys will handle litigation matters initiated against DEDAT, ensure timely filing of court pleadings, oppose cases promptly, and support related legal and labour relations activities. The initiative aims to improve the department’s capacity to respond swiftly to legal challenges, including those involving public entities, Non-Profit Companies, and Trust Companies funded by DEDAT.

Scope

The scope includes:

• Provision of legal services for civil litigation and labour court matters instituted against DEDAT.
• Attending to court pleadings, case preparations, affidavits, and legal consultations.
• Tracing debtors and debt collection on behalf of DEDAT.
• Engagement with legal counsel, including advocates and counsel, as instructed.
• Work may be required within the Northern Cape Province and outside the province, including work for public entities and funded entities related to DEDAT.

Technical Requirements

Private practising attorneys must:

• Be registered with the Legal Practice Council of South Africa.
• Provide legal services in accordance with relevant legislation, including the Constitution, PFMA, Labour Relations Act, PAJA, PAIA, POPIA, Legal Practice Act, and other applicable laws.
• Peruse notices of motion, affidavits, and prepare legal memos on case prospects.
• Coordinate with DEDAT officials for case information, preparation, and court filings.
• Arrange consultations and affidavits certification.
• Advise on case progress and court pleadings readiness.
• Appear in High Court divisions where authorized.
• Trace debtors and manage debt collection processes.

Skills Requirements

Applicants must demonstrate:

• Legal expertise in civil and labour litigation, including court procedures and case management.
• Experience working with advocates and counsel in litigation matters.
• Capacity to handle multiple cases efficiently, with a focus on timely filing and case progression.
• Ability to liaise effectively with DEDAT officials and stakeholders.
• Knowledge of relevant legal frameworks and policies governing public sector legal services.
• Proven experience in debt tracing and collection.
• Strong organizational and communication skills to manage case documentation and reporting.
