Objectives

The primary objective of this tender is to appoint a service provider to review, refine, consolidate, and support the finalisation of the CET Amendment Bill. This process arises from the review of the Continuing Education and Training Act No. 16 of 2006, as amended. The service provider will assist the Department of Higher Education & Training in legislative drafting, policy refinement, and ensuring the legislative documentation aligns with sector needs and stakeholder inputs.

Scope

The scope of work includes:

• Supporting the Department in reviewing, refining, and consolidating the draft CET Amendment Bill and related legislative documents.
• Providing technical and professional legislative drafting support, including working with existing comments matrices, departmental responses, and stakeholder inputs.
• Producing a fully consolidated, legally sound Amendment Bill.
• Accommodating ongoing updates and revisions during the legislative review process.
• Supporting the Department in meeting legislative and parliamentary timelines within a two-month project duration.

Technical Requirements

The technical requirements specify that the service provider must:

• Demonstrate experience in legislative drafting within the education or related sectors.
• Provide a detailed methodology addressing risk management, regulatory compliance, staff and resource management, quality control, and stakeholder engagement.
• Develop and maintain a comprehensive Comments Response Matrix, reflecting affected provisions, departmental responses, and proposed amendments.
• Produce a fully consolidated Amendment Bill that is legally sound and compliant with relevant legislation.
• Ensure the project is iterative, accommodating ongoing inputs and updates.

Skills and Capacity Requirements

The bidder must demonstrate:

• Proven legislative drafting experience, particularly in policy and legal frameworks related to education or similar sectors.
• Experience in managing legislative projects with multiple stakeholders and ongoing revisions.
• Key staff including a Project Leader, Legal Researchers/Drafters, with relevant experience and documented legislative drafting expertise (minimum 2-4 years for key personnel).
• Ability to develop and implement a methodology that addresses risk, compliance, quality, and stakeholder communication effectively.
• Capacity to deliver all project milestones within the specified two-month timeline, ensuring timely support for legislative and parliamentary processes.
