Objectives

The tender aims to appoint a panel of qualified legal professionals to provide legal services to the Cape Agulhas Municipality over a three-year period. The primary objective is to establish a panel (with sub-panels for specific categories) to render legal and advisory services as required, ensuring efficient, professional, and compliant legal support for municipal matters.

Scope

The scope encompasses a broad range of legal categories, with bidders able to tender for any or all of the following:

• A Public and Municipal Law
• B Land Use Planning and Property Law
• C Environmental Law
• D Building, Construction and Engineering Law
• E Labour Law
• F Municipal Supply Chain Management Law
• G Land Tenure Law (including PIE, ESTA, and related proceedings)
• H Conveyancing and Notarial Services (excluding government scheme housing)

The contract duration is three years, with evaluation based on functionality and price, and the successful providers operating from offices within 300 km of Bredasdorp.

Technical Requirements

Bidder submissions must demonstrate compliance with technical eligibility criteria, including:

• Experience in drafting legislation, legal opinions, advising on administrative law, litigation, and administrative proceedings relevant to each category.
• Proven expertise in the specific legal category tendered for, supported by verifiable project experience and references.
• Qualification and experience of lead legal professionals, including minimum post-admission experience (minimum 5 years), legal practicing certificates, good standing certificates, and fidelity fund certificates.
• Access to relevant legal software (e.g., deeds office search software, conveyancing software) with valid licenses.
• Operating from an established office within 300 km of Bredasdorp.
• Compliance with applicable laws, regulations, and professional standards.

Skills Requirements

The skills and qualifications required include:

• Legal professionals admitted to practice in South Africa, with a minimum of five years' post-admission experience in the relevant category.
• Proven track record in municipal legal matters, including drafting legislation, legal opinions, litigation, and administrative law proceedings.
• Ability to provide timely, high-quality legal advice and services, including drafting contracts, legal opinions, and representing the municipality in court or administrative proceedings.
• Experience in handling land use, property, environmental, construction, labour, supply chain, land tenure, conveyancing, and notarial services as applicable.
• Strong project management, communication, and reporting skills, with capacity to operate from an office within the specified geographic radius.
• Adherence to professional and ethical standards, confidentiality, and conflict of interest policies.
