Objectives

The primary objective of the tender is to appoint a Specialist Service Provider (SSP) to compile pre-draft regulations and species lists in terms of section 81 of the Western Cape Biodiversity Act (WCBA). This is to facilitate the effective implementation of section 49 of the WCBA by developing appropriate regulatory instruments and related administrative processes, including stakeholder engagement and administrative procedures under other provisions of the Act.

Scope

The scope of work includes:

• Compiling pre-draft regulations and species lists in accordance with section 81 of the WCBA.
• Engaging stakeholders across various landscapes (e.g., Paarl, Stellenbosch, Robertson, Hermanus, Moorreesburg, Malmesbury, George, Oudtshoorn) to gather input and comments.
• Developing multiple versions of regulations and species lists, incorporating stakeholder feedback.
• Preparing and submitting stakeholder engagement plans, draft regulations, and final reports.
• Providing ongoing updates, attendance records, and response documentation related to stakeholder engagements.

Technical Requirements

The SSP must demonstrate:

• Experience in legislative drafting, environmental law, and biodiversity regulation.
• Understanding of legislation, governance, and regulatory issues at local, provincial, national, and global levels.
• Ability to develop stakeholder engagement strategies, including objective setting, stakeholder identification, and engagement methodologies.
• Capacity to produce comprehensive reports, stakeholder engagement plans, and regulatory drafts within specified timeframes.
• Proficiency in incorporating stakeholder comments into regulatory drafts and species lists.

Skills Requirements

The successful bidder must possess:

• Legislative drafting expertise, particularly in environmental and biodiversity legislation.
• Knowledge of the Western Cape’s biodiversity challenges and legislative context.
• Strong stakeholder engagement and communication skills.
• Project management skills to adhere to timelines and deliverables.
• Experience in preparing administrative and regulatory documentation related to biodiversity laws.
