Objectives

The primary objective of this tender is to establish a panel of qualified legal services providers to support the Government Technical Advisory Centre (GTAC) over a period of five (5) years. The panel aims to facilitate access to diverse legal expertise across multiple categories, ensuring efficient, effective, and transparent legal support for GTAC’s operations and projects.

Scope

The scope encompasses the provision of a wide range of legal services across various categories, including but not limited to:

• Commercial Law and Company Law
• Constitutional Law, Administrative Law, and Public Procurement Law
• Labour and Employment Law
• Litigation and Arbitration
• Capital Markets Law
• Information Technology Law and Intellectual Property Law
• General Legal Advice

The services involve drafting, reviewing, and interpreting legal agreements, providing legal advice on legislative and regulatory matters, supporting infrastructure projects (e.g., PPPs, concession agreements), handling litigation and arbitration, advising on capital markets and compliance, and offering cross-cutting legal support including environmental law, international law, and regulatory compliance.

Technical Requirements

Legal service providers must demonstrate:

• Proven experience and competence in the relevant legal categories, supported by detailed CVs and client references.
• Post-article/admission experience aligned with the specific category of service.
• Qualifications such as degrees or diplomas relevant to law (e.g., LLB, B.Proc.) and registration with the Legal Practice Council or equivalent professional body.
• Capacity to provide legal services in a public sector environment, with understanding of South African legal, political, and economic context.
• Adherence to specified rate tariffs across different tiers and categories, with VAT inclusive rates.
• Compliance with all legal, regulatory, and contractual obligations, including confidentiality, indemnity, and anti-restrictive practices.

Skills Requirements

Legal practitioners and team members must possess:

• Relevant academic qualifications and professional registration.
• Minimum post-article/admission experience as specified per category and tier.
• Demonstrated experience in the relevant legal field, supported by client references and project descriptions.
• Strong understanding of South African public sector laws, regulations, and legal environment.
• Excellent legal drafting, advisory, and litigation skills.
• Ability to interpret complex legal issues and provide clear, actionable advice.
• Capacity to work within budgets, meet deadlines, and respond promptly to service requests.
