Objectives

The primary objective of this tender is to establish a three-year database of qualified professional providers who can be considered for appointment or nomination as curators or statutory managers under the Financial Institutions (Protection of Funds) Act, 28 of 2001. The CMS aims to identify suitable professionals across all provinces to ensure effective regulatory oversight and intervention in cases involving medical schemes or financial institutions that require curatorial or statutory management services.

Scope

The scope of work involves providing services related to the appointment of professionals as curators or statutory managers in accordance with the powers granted under the Medical Schemes Act and the Financial Institutions (Protection of Funds) Act. Specifically, appointed providers may be required to:

• Assist in the identification, nomination, and appointment of suitable professionals for curatorship or statutory management roles.
• Provide expertise and support during the management or control of medical schemes or financial institutions under intervention.
• Deliver agreed-upon services as and when required, following identification for nomination or appointment.

The process involves an evaluation of submissions to form a panel, which may be called upon when specific cases arise requiring curatorial or statutory management services.

Technical Requirements

Applicants must demonstrate:

• Experience in the medical industry or financial services, supported by testimony letters.
• Qualifications in legal, financial, auditing, accounting, risk management, governance, or business management.
• Proven track record in previous curatorships or statutory management, especially within the medical scheme, insurance, or financial sectors.
• Compliance with applicable laws and regulations, including registration with relevant professional bodies and valid good standing certificates.
• Ability to provide services in accordance with the powers and functions outlined in relevant legislation.

Evaluation will consider administrative compliance, eligibility, legal and regulatory adherence, technical competency, and experience.
