Objectives

The primary objective of this tender is to establish a panel of qualified attorneys or law firms to provide specialized legal services to the Amajuba District Municipality over a period of three years. The panel aims to create a database of legal skills that can be contracted as needed to offer legal advice and services in various fields of law, ensuring continuous quality and expertise in legal support for municipal activities.

Scope

The scope includes:

• Registration of legal practices in accordance with the Attorneys Act, 1979 (Act no.: 53 of 1979, amended).
• Provision of legal services including drafting and reviewing confidentiality agreements, commercial leases, building contracts, and legal advice related to Public Private Partnerships.
• Effective and competent legal representation and advice as instructed by the municipality.
• Transfer of skills and knowledge to the municipality’s in-house legal team during the contract period.
• Adherence to the terms of the Service Level Agreement and compliance with procurement and legal standards.

Technical Requirements

The technical requirements for registration and participation include:

• Legal practices must be established in accordance with the Attorneys Act, 1979.
• Submission of verification documents such as CSD report, registration certificates, medical certificates, and tax clearance certificates not older than three months.
• Demonstrated expertise and experience in relevant fields of law, with at least five years of professional experience in the required fields.
• Provision of signed curriculum vitae, good standing certificates, and proof of competency in specialized legal fields.
• Compliance with confidentiality, indemnity, and conflict of interest declarations.
• Acceptance of the contractual conditions including assignment, subcontracting restrictions, and intellectual property rights transfer.

Skills Requirements

The skills and qualifications required include:

• Admitted attorneys with a minimum of five (5) years of experience in relevant legal fields.
• Demonstrated expertise in areas such as confidentiality agreements, commercial leases, building contracts, and Public Private Partnerships.
• Proven track record of providing effective legal advice and services to municipal or similar entities.
• Ability to transfer skills and knowledge to the municipality’s legal team.
• Good standing with relevant professional bodies and a clean professional misconduct record.
• Competency in preparing and submitting all required documentation, including curriculum vitae, registration certificates, and tax compliance certificates.
