Objectives

The primary objective of this tender is to establish a panel of qualified legal service providers, including attorneys and advocates, to deliver legal and advisory services to the Karoo Hoogland Municipality over a period of three (3) years or thirty-six (36) months. The panel aims to facilitate efficient legal support across various fields of law, ensuring the municipality's legal needs are met through a structured and competitive process.

Scope

The scope encompasses the appointment of legal practitioners to provide a broad range of legal services, including but not limited to:

• Legal advisory and litigation services in areas such as Constitutional Law, Municipal Law, Town Planning, Labour Law, Environmental Law, and more.
• Property law, conveyancing, and notarial registrations related to land transactions and land rights.
• Eviction services, investigations under the Code of Conduct for Councillors, and debt collection.
• Legal support for municipal projects, disputes, and other legal matters as instructed via task orders.

Instructions for legal services will be issued on a "Task Order" basis, and no guarantee is given that any service provider on the panel will receive instructions during the contract period.

Technical Requirements

Applicants must demonstrate:

• Compliance with all legal, legislative, and regulatory requirements relevant to the services offered.
• Registration on the Central Supplier Database (CSD) and valid tax compliance PIN or certificate.
• Experience in relevant fields of law, including litigation, advisory, property transactions, and specialized legal services.
• Proven capacity to handle both straightforward and complex legal transactions, including advanced property transactions and court litigation.
• Availability of qualified legal practitioners with appropriate expertise and experience in the specified legal fields.
• Operational offices within a 700 km radius from Williston to facilitate cost-effective service delivery.
• Provision of necessary supporting documents such as CVs, proof of experience, professional registration certificates, fidelity fund certificates, and good standing certificates.

Skills Requirements

Applicants must possess:

• Legal expertise in the specified fields of law, including constitutional, municipal, property, environmental, and commercial law.
• Experience in court litigation at Magistrate and High Court levels, with evidence of relevant cases and judgments.
• Strong advisory skills and the ability to provide sound legal opinions and guidance to municipal officials.
• Capacity to handle property conveyancing, notarial registrations, and complex land transactions.
• Experience in municipal law, governance, investigations, and dispute resolution mechanisms.
• Ability to deliver services efficiently within stipulated timeframes and adhere to professional standards and legislative compliance.
• Capacity to support the municipality in investigations, debt collection, and legal support for municipal projects and policies.
