Objectives

The primary objective of this tender is to appoint a service provider to perform legal functions related to appeal matters under Section 61 of the KwaZulu-Natal Liquor Licensing Act No 06 of 2010. The appointed provider will assist the Department of Economic Development, Tourism and Environmental Affairs (EDTEA) in finalizing appeals lodged against decisions of the KwaZulu-Natal Economic Regulatory Authority (KZNERA), ensuring timely resolution within legislated timeframes, and providing legal advice, analysis, and recommendations to prevent future appeals.

Scope

The scope includes:

• Receiving, considering, and finalizing appeals lodged under Section 61 of the Liquor Licensing Act.
• Conducting legal analysis, hearings, and producing detailed reports with findings, jurisprudence, and recommendations.
• Developing an early warning system to identify and address potential future appeals.
• Providing legal expertise through a team comprising legal advisors with relevant qualifications and experience.
• Engaging in case-by-case contractual arrangements for each appeal received over a period of two years.
• Supporting the department in improving decision-making processes and preventing recurrence of similar appeals.

Technical Requirements

The technical requirements include:

• Legal experts with LLB qualifications and admission as attorneys of the High Court.
• Minimum of 5 to 13+ years of experience in legal research, tribunal or appeal processes, and public sector legal work.
• Provision of detailed CVs for key personnel demonstrating relevant expertise.
• Ability to conduct hearings, analyze legal documents, and produce comprehensive reports supported by jurisprudence.
• Experience in managing similar legal projects, evidenced by reference letters or awards.
• Compliance with the department’s reporting, record-keeping, and meeting attendance requirements.
• Availability to commence immediately after appointment and work within legislated timeframes.
