Objectives

The primary objective of this tender is to appoint a panel of legal service providers to deliver comprehensive legal services to Namakwa District Municipality over a period of 36 months. The services include legal advice, representation, drafting, review of legal documents, policy development, litigation, and specialized legal support in areas such as municipal law, labour law, contract law, and other related legal fields.

Scope

The scope encompasses the provision of legal services in the following areas:

• Public & Administrative Law (including constitutional law, municipal legislation interpretation, MFMA, Treasury Regulations)
• Labour Law (disputes, representation at SALGBC, CCMA, Labour Court, employment contracts)
• Contract & Commercial Law (drafting, vetting, compliance, risk review)
• Litigation (representation in Magistrates’ Court, High Court, Supreme Court of Appeal, Constitutional Court, CCMA, Equality Court, statutory tribunals)
• Municipal & Legislative Support (municipal planning law, property rates, SPLUMA, by-laws, town planning, building regulations, property transfers)
• Special Assignments (legal interpretation, compliance advisory, complex transactions, investigations)
• Policy Development (drafting and reviewing council policies)
• Revenue Enhancement (debt collection litigation, revenue recovery)
• Additional areas such as construction law, environmental law, evictions, insurance law, and other specialized legal services

Technical Requirements

The legal service providers must:

• Be capable of providing legal advice, drafting, review, and representation across the specified legal areas
• Demonstrate experience in municipal law, litigation, and specialized legal fields
• Have personnel with appropriate qualifications, experience, and capacity, including legal practitioners and support staff
• Provide services in accordance with applicable national and international standards
• Meet the mandatory compliance and registration requirements, including registration with the Legal Practice Council or relevant Bar Council, Fidelity Fund Certificate, and tax compliance
• Be able to respond promptly to legal requests, with specified turnaround times

Skills Requirements

Potential service providers must demonstrate:

• Proven expertise in municipal, administrative, labour, contract, and litigation law
• Experience in handling complex legal matters, policy drafting, and legal advisory services
• Capacity to provide timely legal opinions, representation, and support in court and administrative tribunals
• Strong legal research and analytical skills
• Ability to draft clear, comprehensive legal documents and policies
• Experience in specialized legal areas such as eviction law, insurance law, environmental law, and construction law (advantageous)
• Capability to handle multiple legal matters simultaneously and deliver services within stipulated response times
