Objectives

The primary objective of this tender is to establish a panel of qualified legal service providers to deliver a broad range of legal and ancillary services to Letsemeng Local Municipality over a period of three (3) years. The services aim to support the municipality in legal advisory, litigation, drafting, investigations, conveyancing, debt collection, and other specialized legal functions as required from time to time.

Scope

The scope encompasses the appointment of service providers across multiple legal categories, including but not limited to:

• General legal advisory services in areas such as public and municipal law, town planning, construction, labour, SCM, commercial, IP, eviction, and insurance law.
• Drafting of by-laws and policies.
• Specialist legal practitioners in areas like municipal investigations, HR/labour law, procurement, environmental, commercial, forensic investigations, conveyancing, and notarial services.
• Investigations related to the Code of Conduct for Councillors.
• Debt collection services.
• Conveyancing and notarial registrations for property transactions.

The services will be rendered on an as-and-when-required basis, with appointments to the panel for a fixed term of three years.

Technical Requirements

The technical requirements include:

• Legal practitioners must be admitted attorneys with relevant experience in the specified service categories.
• Provision of detailed CVs and proof of registration with professional bodies.
• Capacity to handle litigation in Magistrate and Higher Courts, investigations, drafting, conveyancing, and debt recovery.
• Capacity to provide guarantees, insurance, and industry-specific expertise, especially in eviction and insurance law.
• Infrastructure to support electronic communication, data management, and secure handling of sensitive information.
• Compliance with all statutory and municipal legal requirements, including tax compliance and professional registration.

Skills Requirements

The skills and qualifications required from bidders include:

• Admitted attorneys with proven expertise in the relevant legal fields.
• Experience in municipal and public sector legal matters, including litigation, investigations, and advisory services.
• Capacity to conduct forensic investigations and manage complex legal disputes.
• Skilled personnel with CVs demonstrating relevant experience in debt collection, conveyancing, and specialized legal services.
• Ability to operate infrastructure supporting electronic data exchange, reporting, and secure communication.
• Knowledge of municipal policies, housing policies, and relevant legislation.
• Capacity to provide professional legal services in multiple legal areas, including eviction, insurance, environmental, and commercial law.
