Objectives

The primary objective of this tender is to establish a panel of qualified legal practitioners to provide comprehensive legal services to Ugu District Municipality over a period of thirty-six (36) months. The panel aims to facilitate legal support across various areas including litigation, contract development, conveyancing, legal opinions, and enforcement of by-laws, ensuring effective legal management and dispute resolution for the municipality.

Scope

The scope of work encompasses:

• Representation in litigation initiated by or against the municipality across courts and tribunals.
• Legal advice and opinions on a wide range of municipal matters.
• Drafting, vetting, and enforcement of contracts, lease agreements, and service level agreements.
• Drafting and enforcement of municipal by-laws and regulations.
• Conveyancing work including property transfers, servitude registrations, and land rights.
• Legal support in land registration, expropriation, and landowner tracing.
• Analysis and reporting on legal processes and internal procedures.
• Provision of legal support and specialist assignments as required.
• Registration of municipal property and infrastructure.

Technical Requirements

Applicants must demonstrate:

• Experience and expertise in relevant legal areas such as litigation, conveyancing, labour law, and contract law.
• Listing of practitioners authorized to appear in the High Court and support staff within the firm.
• Provision of a company profile indicating qualifications and experience of principals and legal practitioners.
• Proof of a registered office within KwaZulu-Natal and, where applicable, a registered conveyancer.
• Compliance with all statutory and regulatory requirements, including tax clearance, BBBEE certification, Fidelity Fund certificate, and municipal account or affidavits.
• Adherence to the prescribed pricing schedules for legal services over three years.
• Completion of all required forms, declarations, and supporting documents as specified in the tender documentation.

Skills Requirements

Applicants must possess:

• Legal practitioners with proven experience in municipal law, litigation, conveyancing, and contract law.
• Support staff with relevant legal qualifications and experience.
• Ability to provide timely, accurate, and comprehensive legal advice and services.
• Capacity to handle multiple legal matters efficiently, including court appearances and legal drafting.
• Strong understanding of municipal legal frameworks, policies, and regulations.
• Excellent communication and reporting skills to facilitate effective liaison with the municipality’s Legal Services Unit.
