Objectives

The primary objective of this tender is to procure litigation services for the South African Social Security Agency (SASSA). The services include engaging attorneys to conduct litigation within the Gauteng region, supporting SASSA's debt collection efforts, and ensuring legal representation and related legal activities are effectively managed.

Scope

The scope of work encompasses:

• Procurement of attorneys qualified to provide litigation services in Gauteng.
• Conducting defended and undefended legal cases as specified in the service requirements.
• Providing reports on the work undertaken to the satisfaction of SASSA.
• Engagement is region-specific (Gauteng) and includes all related terms and conditions as outlined in the tender documentation.
• Work will commence only after official purchase orders are issued and proper handover to the project manager.
• The contract period aligns with the debt collection contract ending on 31 March 2027.

Technical Requirements

The technical requirements include:

• Legal registration and compliance:
  • Attorneys must be admitted, enrolled with the Legal Practice Council, and possess a valid Fidelity Fund Certificate.
  • Attorneys must hold an LLB degree, complete practical legal training, pass competency examinations, and be admitted by the High Court.
  • Possess a certificate of appearance from the High Court Registrar for superior court appearances.
• Experience:
  • Project managers must have at least 3 years of relevant experience, supported by CV and qualifications.
  • Attorneys and companies must demonstrate at least 3 years of relevant legal and operational experience, supported by appointment letters and reference letters.
• Administrative compliance:
  • Registration on the Central Supplier Database (CSD).
  • Valid SARS tax verification PIN.
  • Completion and signing of all required Standard Bidding Document forms (SBD 3.1, SBD 4, SBD 6.1).
• Pricing:
  • Fixed, all-inclusive rates (including VAT) for defended and undefended cases, based on the attached cost template.

Skills Requirements

The skills and qualifications required include:

• Legal expertise with admitted attorneys registered with the Legal Practice Council.
• Proven experience in litigation, particularly in defending and prosecuting cases within the Gauteng region.
• Experience in managing legal projects, including reporting and compliance documentation.
• Ability to provide legal services efficiently within the stipulated contractual and regional scope.
• Knowledge of procurement procedures and compliance with the tender requirements.
