Objectives

The primary objective of this tender is to appoint a service provider to study and advise on the intergovernmental relations concerning the current configuration of powers and functions across the three spheres of government (national, provincial, and local) and between the two tiers of local government. The project aims to:

• Research the efficacy and efficiency of the distribution of powers and functions as allocated by the Constitution and legislation.
• Analyze the decentralization, devolution, assignment, and delegation of powers and functions to various spheres and tiers of government.
• Provide recommendations and options for reconfiguring powers and functions to address existing challenges such as overlaps, ambiguities, and inefficiencies.
• Engage stakeholders and produce comprehensive reports on the current state and potential improvements in intergovernmental relations.

Scope

The scope of the project encompasses:

• Studying the constitutional, legislative, and policy environment related to intergovernmental relations and the distribution of powers and functions.
• Conducting research on the effectiveness and appropriateness of the current allocation of powers and functions, including those decentralized or delegated to other spheres and within local government tiers.
• Analyzing existing research, legislation, and regulatory frameworks that distribute or assign powers and functions.
• Assessing the efficacy and efficiency of powers and functions in practice, including fiscal allocations and resource distribution.
• Engaging key stakeholders such as the Financial and Fiscal Commission, Local Government Association, National Treasury, Municipal Demarcation Board, and others.
• Providing detailed reports, recommendations, and options for reconfiguration of powers and functions.
• Participating in departmental seminars and roundtable discussions throughout the project duration.

Technical Requirements

The technical requirements for the tender include:

• Expertise and Qualifications:
  • Qualification at NQF level 7 in law or public administration for the Project Leader.
  • Team members with tertiary qualifications in finance, development planning, and civil engineering.
  • Experience in intergovernmental relations, constitutional law, public administration, and related fields.
• Research and Analysis Skills:
  • Ability to interpret legislation, policy, and constitutional provisions.
  • Data collection, analysis, synthesis, and report writing skills.
  • Experience in policy development, legislative drafting, and regulatory frameworks.
• Project Management:
  • Development of detailed project plans, risk mitigation strategies, and stakeholder engagement plans.
  • Adherence to timelines and milestones as specified in the project schedule.
• Stakeholder Engagement:
  • Ability to engage with diverse stakeholders including government departments, agencies, and key institutions.
• Deliverables:
  • Inception report, progress reports, and final comprehensive report with recommendations.
  • Participation in seminars and presentations throughout the project duration.
