Objectives

The primary objective of this tender is to appoint attorneys to provide legal services on an ad-hoc basis for a period of thirty-six (36) months. The services aim to support the Dawid Kruiper Municipality in legal actions related to debt collection, legal advice, and incidental legal matters, ensuring effective recovery of monies owed to the municipality and legal assistance in relevant legal processes.

Scope

The scope includes:

• Legal action processes for debt collection, including judgments, credit listings, and Section 65 proceedings.
• Provision of legal advice and assistance in various legal matters as they arise during the contract period.
• Representation in court for civil and debt recovery cases, including defended and undefended actions.
• Preparation and filing of legal documents such as summons, pleadings, affidavits, and applications.
• Legal support for proceedings related to liquidation, business rescue, and execution of court judgments.
• Legal services related to the recovery of municipal debts and other incidental legal matters as required by the municipality.

Technical Requirements

The technical requirements specify that:

• Legal practitioners must possess valid admission certificates (Court Order), a valid Fidelity Fund Certificate, and a Certificate of Good Standing issued by the South African Legal Practice Council.
• Law firms must demonstrate a well-established presence, relevant experience, and a proven track record in debt collection and legal services for public sector entities.
• Proposed team members must have relevant qualifications and experience, with certifications not older than three months.
• Legal services must comply with applicable legislation, including the Magistrate’s Court Act, Debt Collectors Act, and other relevant laws and policies.
• Pricing must be based on prescribed tariffs for various legal services, including court appearances, drafting, consultations, and other legal proceedings, as per government gazette tariffs.
• Service providers must supply detailed documentation, including reference letters, proof of similar work, and firm establishment proof, to substantiate their capacity.

Skills Requirements

The skills and expertise required from bidders include:

• Legal expertise in debt collection, civil litigation, and public sector legal matters.
• Proven experience in handling court proceedings, drafting legal documents, and representing clients in court.
• Knowledge of relevant legislation such as the Legal Practice Act, Magistrate’s Court Act, and Debt Collectors Act.
• Ability to provide sound legal advice and support in complex legal issues related to municipal operations.
• Capacity to manage multiple cases efficiently, maintain accurate records, and report progress regularly.
• Demonstrated competence in working with government entities and understanding of local government legislation and policies.
