Objectives

The primary objective of this tender is to establish a panel of service providers who will deliver mediation services to indigent land reform beneficiaries. These services are aimed at resolving disputes related to land rights and tenure under various legislative frameworks, including the Land Reform (Labour Tenants) Act, Extension of Security of Tenure Act, Restitution of Land Rights Act, and other policies administered by the Department of Land Reform and Rural Development (DLRRD).

Scope

The scope of work includes:

• Providing mediation and conciliation services to parties involved in land rights disputes.
• Receiving case allocation letters from DLRRD and consulting with officials and clients at their convenience.
• Conducting fact-finding exercises, preparing reports, and developing project execution plans with milestones and budgets.
• Filing monthly progress reports and invoices, attending review meetings and training sessions.
• Entering into service level agreements and ensuring quality service delivery.
• Providing mediation on issues such as contested claims, intra-community disputes, and disagreements over restitution forms.
• Managing cases within a three-year contractual period, with the possibility of application for replacement or extension.

Technical Requirements

Applicants must demonstrate:

• Knowledge of mediation processes and land reform legislation.
• Experience in mediating land reform or related projects, with a minimum of three completed projects.
• Ability to prepare detailed reports, project plans, and budgets.
• Independence, neutrality, and acceptability to all parties involved.
• Understanding of land rights, customary tenure, and constitutional rights.
• Confidentiality and record-keeping skills.
• Compliance with all administrative and contractual obligations, including reporting and invoicing.

Skills Requirements

Service providers must possess:

• Proven mediation skills with at least 2 years' post-admission experience (certified proof required).
• Successful mediation of at least three land reform or related projects, with supporting evidence.
• Strong communication and interpersonal skills to build trust and rapport with clients and parties.
• Ability to manage multiple cases efficiently within stipulated timeframes.
• Understanding of land reform policies, legal frameworks, and court processes.
• Capacity to prepare comprehensive reports, case files, and closeout documentation.
• Availability to respond promptly to case allocations and participate in mandatory training and review sessions.
